1. Agreement to Terms

These Terms and Conditions ("Terms") constitute a legally binding agreement between you ("User") and Black Device SRL ("Company", "we"), regarding your access to and use of easyrag.com. By accessing the Website, you agree to be bound by these Terms.

2. Description of Service

easyrag.com provides an AI-powered platform utilizing Retrieval-Augmented Generation (RAG) technology to allow users to interact with their own data.

3. User Accounts

  • Registration: You must provide accurate and complete information during registration.
  • Security: You are responsible for maintaining the confidentiality of your credentials. You must notify us immediately of any unauthorized use of your account.
  • Eligibility: You must be at least 18 years old to use this service.

4. Subscriptions and Payments

  • Fees: Access to certain features requires a subscription. Prices are displayed on the Website and are subject to change with notice.
  • Billing: Payments are processed securely via third-party providers. By subscribing, you authorize us to charge your payment method on a recurring basis.
  • Refunds:
    • Consumers (B2C): According to OUG 34/2014, you generally have a 14-day right of withdrawal. However, by using our digital content (AI generation), you acknowledge that you lose the right of withdrawal once the performance has begun with your prior express consent.
    • Business (B2B): Refunds are granted at the sole discretion of Black Device SRL.

5. Intellectual Property

  • Our IP: The easyrag.com platform, code, logo, and design are the property of Black Device SRL and are protected by Romanian and international copyright laws.
  • Your IP: You retain all ownership rights to the documents and data you upload. You grant us a limited, non-exclusive license to process this data solely to provide the service to you.
  • AI Output: Subject to your compliance with these Terms, Black Device SRL assigns to you all right, title, and interest in the output generated by the AI for you.

6. Acceptable Use

You agree NOT to use the platform to:

  1. Upload illegal, harmful, or infringing content.
  2. Reverse engineer or attempt to extract the source code of the platform.
  3. Use the AI to generate spam, deepfakes, or misinformation.
  4. Resell access to the platform without our written permission.

7. AI Disclaimer (Important)

Artificial Intelligence is probabilistic.

  • Accuracy: The services use advanced AI models, but they may occasionally produce incorrect, misleading, or offensive information ("hallucinations"). You should verify any output before relying on it.
  • No Professional Advice: The AI output is not a substitute for professional legal, medical, or financial advice.

8. Limitation of Liability

To the maximum extent permitted by Romanian law:

  • Black Device SRL shall not be liable for any indirect, incidental, or consequential damages (including loss of data or profits).
  • Our total liability for any claim arising out of these terms is limited to the amount you paid us in the 12 months preceding the claim.

9. Termination

We reserve the right to suspend or terminate your account immediately, without prior notice, if you violate these Terms.

10. Governing Law and Jurisdiction

  • These Terms are governed by the laws of Romania.
  • Any disputes shall be attempted to be resolved amicably. If this is not possible, the dispute shall be submitted to the competent courts in Bucharest, Romania.
